When the government grants an 'exclusive' contract, during the duration of said contract, the government cannot award another contract for the exact same product to any other company on their own doing. When a contract is coming to an end, then the government can renegotiate the contract and/or take bids from others for a new contract. However, during the active period of the contract, only the holder of that contract can authorize the government to award a subcontract to another company. Otherwise, the government can be sued for "breach of contract" by the company having been awarded the exclusive contract. This HAS been proven, as the government has attempted to circumvent this a few times in the past, were sued, and the company suing the government won.Willys didn't authorized anything, they didn't have any right on the Jeep, plans and patents of the Jeep were property of the gouvernment back then ... Willys was granted with the first production contract by the Army, then the Army decided to also grant a contract to Ford as Willys wasn't able to produce enough vehicles.
Having worked for a government contractor in the past, as well as knowing many others who have (including a couple of company owners), I am aware of how it works.
