Sold my truck or so i thought

question for you guys. sold a 1980 chevy k20. pretty nice truck.. we agreed on 3k for it. hes a bunch of states away, wired me 1200 deposit. said he would work on getting up here. been 11 days. called a few hours ago said he needs the money back. ok i guess. sucks but things happen. said ill send 950 right away. i should get something for my waste of time. turned away other buyers too. he flipped a shit. even threatened me. see know reason to care. i tried to help someone. now i get screwed? feel like i should at least get something you know?? thoughts?? last time i do this
 
send it all back and make sure the next guy doesnt waste your time.

thats what i would do...
 
Yeah, unless you told him the deposit, or part of the deposit, was non-refundable up front, then swallow your pride and send the deposit back.
 
Deals a deal. Tell him to bring the money and he'll get his truck. Lol.
REALLY. Give it back and make sure you tell the next guy there will be a 250 deposit no return.

He wanted your truck, sent you money to hold - found another truck he wanted and wants all his money back. I feel a less than 10% loss on his part isn't bad - and depends on how many calls on the truck

Doing anything else would not be cool in my book.
Deposits are non refundable in my book if they back out & I am up front with that.

Only an idiot would send a stranger $1200 without some kind of insurance that your not getting ripped off. Not to mention buying a vehicle site unseen is stupid by definition. On the other hand trying to keep the guys money for your "time" with out a previous agreement is pretty shady. I wouldn't do business with either of you:roll:

A deposit is a promise that you are buying it. Any deal I have ever made and put a deposit on it, it was non refundable.


I think you should get something, ask the guy what he thinks is fair for you to keep. If he says 0, say what money.

Never the less the other guy is a prick.

They had a previous agreement, the guy sent money, I think he agreeded he was going to buy it.

I agree no doubt he intended to buy it sending that much money but nothing was said about refunding the deposit or how much that refund would be. I've never dealt with a business with a non refundable deposit that it wasn't stated upfront and clearly. I couldn't in good conscious keep the money but that's just me.
 
Whether a deposit is refundable or not is dependant on the contract between buyer and purchaser..could go either way in court but i would send the $$ back and consider it lesson learned if you didnt state at the time of the deal you would keep the deposit in the event of him not coming up with the rest..shitty deal but you still have your truck.
 
A non-refundable deposit would be understandable, but if you didn't tell him beforehand, cough it up and consider it a lesson learned.
 
I've sold several cars where the buyer gave me an up-front payment, with the balance due when they picked it up. Every time the deal was done in writing (doesn't matter on what, just as long as you each get a copy and is signed by both of you) and with an agreement that $X amount of that initial payment was non-refundable should they back out. I also kept the title and the car until it was all paid for.

A couple times the initial buyer backed out, they were refunded everything minus what was agreed upon. No room for complaints, no threats, no bad feelings on my part.

Doing it all verbally is stupid on both of your parts.
