Colonel Van T. Barfort, 90, from Richmond VA is being ordered by his homeowner association to remove the flag pole on his property.
Did you miss it? Look at the Colonel’s picture again. See what’s hanging around his neck? Yep.
The Congressional Medal of Honor.
“The decorated veteran of three wars, now 90 years old, raises the American flag every morning on the pole, then lowers and folds the flag at dusk each day in a three-corner military fashion.”
You pissed yet? If not. Leave. Immediately.
From the Richmond Times Dispatch:
In a priority mail letter, the Coates & Davenport law firm in Richmond is ordering Barfoot to remove the pole by 5 p.m. Friday or face “legal action being brought to enforce the Covenants and Restrictions against you.” The letter states that Barfoot will be subject to paying all legal fees and costs in any successful legal proceeding pursued by the homeowner association’s board.
Barfoot lives in the Sussex Square community in far western Henrico; its board of directors rejected a plea from Barfoot in July to approve the pole, disallowing the fixture on aesthetic grounds.

So here is what all of us need to do for Colonel Barfoot. It is the very least we can do for him in return for his heroic service, sacrifice, and patriotism for us all.

Leave messages with both places - it's quick and easy and they ask for very little info.

:mrgreen: just fired off a polite but nasty note to them...... send it and it said they will respond soon.....:lmao:

Seems like they have recieved quite a few emails already!! I can't find anything else on them.

My question is since they claim aesthetic reasons for removing the pole, who's making the decision on what is, or is not acceptable for viewing? If that was my HOA, I'd contact every neighbor under the HOA and get them to demand the lawsuit be terminated. HOA board members are voted in by the people in the HOA (that's how it works for mine). The way I see it, they serve those people and majority vote wins. Where are this guys neighbors?!?

Not to take up for the HOA, but he did bring this on himself. He was advised that erecting the pole was against the rules. I agree there should be an exception placed just b/c he is a Medal of Honor War Hero and 90 yrs old.

His HOA's rules may be different, but I know alot of the ones in the Phoenix area had a rule that if it wasn't in the builders/landscapers plan, its not allowed.

A few years ago there was a story that actually made front page in the newspaper there about somebody who put a sitting bench just off of thier front porch. The HOA Nazi's came down hard on them with a rediculous amount of fines. His neighbor had one just of of his porch, but since it was in the build plan there was no problem.

Some even regulate your landscaping in the front yard. If the house was build with X amount of trees or bushes and X amount of sq ft of grass or rock, you couldn't change it without getting fined.

Some will go as far as what you do in the back yard as well. I was helping my bro-in-law sod his back yard when the head of the HOA came by and asked if he had a permit to be doing that. :shock:

HOA's in some developements can also evict you from your own house if you leave your fines unpaid.
 
After reading the Federal law on it linked in the pirate thread, I think he's going to be just fine. Having said that though, Homeowners associations can be both a blessing and a curse. They are implemented to keep out the stupid stuff like Bubba bringing in a car and setting it on blocks in his front yard in a nice neighborhood. But also, they can be fawkin horrid when the idiots become the ones in charge of it, or someone collectively disliked by the members of the assoc. does something that even skirts the rules. They are designed to protect the look of a neighborhood, but more often than not, they seem to cause more drama than they solve... :|
 
He is a CMoH winner. He should be able to fly the flag(of any size) any way he sees fit. His blood(and the blood of his generation) are coloring the flag:evil:

The Home Owner's Association has dropped the request from him to remove it.

HOA's are becoming too liberal like our government! I say unless they are paying your morgate.....tell them to F* off!!!!

His picture, along with many others, needs to be put next the definition of a REAL FAN OF AMERICA!!!! God bless him!! I love driving to work every morning and seeing the American Flags flying high!!! Does our constitution not mean anything to anyone anymore???!!!

Well thats good that they dropped the case, too bad I didnt read it at the end because I immediately emailed the attorney's

All I have to say it this. it doesnt matter if your a Rep. or a Dem. This man is a Medal of Honor War Hero.
He can take a dump on my livingroom floor and I will let him do it for what he edured to get that honor of having that medal presented to him. End of story!
